Welcome to Be Prepared, operated by Be Prepared, Inc., a corporation incorporated in the State of Delaware and operating in New Jersey ("we," "us," "our," "Company"). By accessing or using our website, application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

**IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.**

These Terms constitute a legally binding agreement between you and Be Prepared, Inc. By creating an account, accessing content, or using any features of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

## [2\. Eligibility and Account Registration](#eligibility)

You must be 18 years or older to use Be Prepared. You're responsible for maintaining account security and the accuracy of your information. One account per person.

### 2.1 Age Requirement

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or provide services to individuals under the age of 18.

### 2.2 Account Registration

To access certain features of the Service, you must create an account by providing:

-   A valid email address
-   A secure password
-   Accurate personal information as requested

You agree to provide accurate, current, and complete information during registration and to update your information to maintain its accuracy.

### 2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

-   Use a strong, unique password for your account
-   Not share your password with others
-   Notify us immediately of any unauthorized use of your account
-   Log out of your account at the end of each session

**You are solely responsible for any activities or actions taken under your account,**whether or not you authorized such activities.

### 2.4 One Account Per User

You may only create one account. Creating multiple accounts to circumvent subscription limits or other restrictions is prohibited and may result in termination of all your accounts.

## [3\. Description of Services](#services)

Be Prepared offers four product suites: BeAware (real-time emergency monitoring), BeReady (AI-powered preparedness planning), BeAdvised (educational preparedness discussions), and BeEquipped (curated preparedness marketplace). Each product has specific capabilities and limitations described in this section.

### 3.1 BeAware — Situational Awareness Monitoring

BeAware provides situational awareness by polling third-party utility outage feeds, FEMA IPAWS emergency alerts, and environmental data sources, and surfacing them in your dashboard. Although our marketing may describe BeAware as "real-time," the Service is more accurately described as a polled, near-real-time monitoring tool. Key features and limitations include:

-   Monitors utility outage feeds, FEMA IPAWS emergency alerts, and environmental data sources (AirNow, USGS gauges, NWS, WFIGS active fire perimeters)
-   Geocodes user addresses to identify serving utilities and overlapping hazard footprints
-   Generates 10-year baseline location reports using federal data sources (USGS, NOAA, FEMA, EPA AQS, USFS, NFIP) and AI synthesis
-   **Data is polled at intervals (typically 2–60 minutes depending on source); alerts can be delayed, missing, incorrect, or repeated.** The absence of an alert does not indicate the absence of an emergency.
-   Coverage is US-centric and not all utilities, regions, or hazard types are monitored
-   BeAware does not contact emergency services on your behalf, does not actively monitor users, and does not guarantee delivery of any notification

⚠️ IMPORTANT: BeAware is a supplemental information service, NOT a replacement for official emergency warning systems (Wireless Emergency Alerts, NOAA Weather Radio, or local emergency management). Do not rely on BeAware as your sole source of emergency information.

### 3.2 BeReady — AI-Powered Preparedness Planning

BeReady generates personalized emergency preparedness plans using artificial intelligence. We currently route requests through OpenRouter to large language models including Anthropic Claude, OpenAI GPT, and Google Gemini; the active model and provider may change at any time. Plans may include guidance about supplies, evacuation routes, medication, shelter-in-place protocols, and other topics. **This guidance is not professional advice.**

-   Plans are AI-generated recommendations for **informational and educational purposes only**
-   Plans are point-in-time documents and may become outdated as circumstances, regulations, products, or hazards change
-   Plans may contain factual errors, omissions, hallucinations, or guidance that conflicts with official emergency instructions
-   Users are responsible for reviewing, customizing, validating, and maintaining their plans, and for consulting qualified professionals (medical, structural, legal, emergency management) for specific decisions
-   BeReady is **not a substitute for professional emergency management consulting, medical advice, structural assessment, or government emergency programs**
-   **You must acknowledge an on-screen safety notice before generating your first BeReady plan.** We record the version of the notice you accepted, the time of acceptance, and the IP address used. Continuing to view, share, download, or rely on a generated plan reaffirms that acknowledgement.

### 3.3 BeAdvised — Educational Preparedness Discussions

BeAdvised provides 1:1 video sessions with Be Prepared founders on general preparedness topics.

-   Sessions are **educational discussions, NOT professional consulting**
-   Be Prepared founders and any other persons leading a session are **not licensed emergency management professionals, medical providers, attorneys, structural engineers, financial advisors, or any other licensed profession,** and are not holding themselves out as such, regardless of session topic (which may include "structural hardening," "medical prep," "evacuation planning," or similar labels used for marketing purposes)
-   No professional-client, doctor-patient, attorney-client, or engineer-client relationship is created by a BeAdvised session
-   Nothing discussed in BeAdvised sessions constitutes professional, medical, legal, structural, or financial advice and may not be relied upon as such
-   Users should consult qualified, licensed professionals for specific safety, medical, structural, legal, or financial questions before acting
-   Before scheduling and again before joining a session, you will be shown an on-screen credential disclosure. Booking a session confirms you have read and accepted that disclosure
-   No session recordings are made or provided

### 3.4 BeEquipped — Curated Preparedness Marketplace

BeEquipped offers pre-made preparedness kits and a build-your-own kit builder. BeEquipped operates under two distinct fulfillment models, and the BeEquipped interface tells you which one applies before you check out:

-   **Amazon cart hand-off (current default for most kits).** When you complete a kit, we send you to Amazon (or another retailer) with a pre-populated shopping cart of recommended items. **You purchase from the retailer, not from Be Prepared.** Once you leave our Service for the retailer, we have no visibility into or control over the transaction, fulfillment, returns, or warranty. The retailer’s terms, prices, taxes, and policies govern.
-   **Direct sale by Be Prepared, Inc. (when offered).** Items marked "Sold by Be Prepared" at checkout are sold by Be Prepared, Inc. as the merchant of record, with the limited 14-day return policy described in Section 6.2.2.

In either model:

-   Products have been selected based on publicly available specifications, reviews, and relevance to emergency preparedness
-   Be Prepared, Inc. does not independently test all products and makes no warranty regarding their performance, safety, or fitness for any particular purpose
-   Product suggestions are informational, not exhaustive — they may not include all items needed for your specific situation
-   BeEquipped participates in the Amazon Associates Program and other affiliate programs; see Section 10
-   Refund, return, and warranty rights are governed by Section 6.2

**Kit and product images are representative, not photographs of what you will receive.** The images shown for kits and items are AI-generated, representative illustrations that convey the nature of a kit and the kind of items it contains. They are not photographs of the specific brands, models, or quantities you will receive, and they may depict items that differ from, or are not identical to, the products actually supplied. Because we curate our kits on an ongoing basis, the specific products in a kit change over time as availability, price, and reviews change; the representative image stays constant while the underlying products are optimized. **You will see the specific products you are purchasing, identified by name, before you complete checkout.** This point-of-use disclosure is described further in Section 8.6.

### 3.5 BeAdvised Sessions

BeAdvised sessions are provided live. No recordings of BeAdvised sessions are made available to users.

## [4\. Notifications and Communications](#notifications)

By providing your email, phone number, or enabling push notifications, you consent to receive transactional, account, and emergency-related communications from Be Prepared. SMS (if offered) is opt-in and rate-dependent. Delivery is not guaranteed; never rely on Be Prepared notifications as your only warning channel.

### 4.1 Transactional and Account Communications

When you create an account or interact with the Service, you consent to receive transactional email at the address associated with your account, including account verification, password and one-time-code (OTP) messages, billing receipts, subscription notices, security alerts, and other messages required to operate the Service. These messages are not marketing and you cannot opt out while maintaining an active account.

### 4.2 Marketing Communications

With your consent (typically expressed in your account preferences), we may send newsletters, product announcements, educational content, and other marketing email. You may opt out at any time through the unsubscribe link in each marketing message or in your account settings. Opting out of marketing does not opt you out of transactional or safety communications described in Section 4.1 or 4.4.

### 4.3 SMS and Phone Number Use (Where Offered)

Where Be Prepared offers SMS alerts, voice notifications, or other communications to a phone number you provide, the following terms apply:

-   SMS is **express opt-in only**. You may opt in by checking a box, replying YES, or completing a documented opt-in flow
-   You may opt out at any time by replying STOP (or the locally equivalent keyword) to any SMS message, by emailing us at the address in Section 18, or through your account settings
-   Reply HELP for assistance. Message and data rates may apply. Frequency depends on the alert types you have enabled
-   We do not sell or share phone numbers for telemarketing
-   By providing your phone number, you represent that you are the subscriber or customary user of the number and authorized to receive automated messages at that number
-   You agree that automated telephone dialing systems may be used to deliver SMS alerts you have opted in to receive, and acknowledge that consent to automated messages is not a condition of purchase

### 4.4 BeAware and Safety Notifications

BeAware alert delivery (email, in-app, push, or SMS where offered) is provided on a commercially reasonable basis only. **We do not guarantee delivery, timing, accuracy, completeness, relevance, or geographic coverage of any notification**, and we may suspend, throttle, or discontinue any notification channel at any time without notice.

Common causes of missed, delayed, or duplicated alerts include carrier outages, push-notification service failures, third-party feed delays or errors, your device's do-not-disturb settings, spam filtering, internet outages, your account being suspended for non-payment, and infrastructure incidents during the same event the alert concerns. **Treat Be Prepared notifications as a supplement to, never a substitute for, Wireless Emergency Alerts, NOAA Weather Radio, and instructions from local emergency authorities.**

### 4.5 Push Notifications

You can enable or disable push notifications through your device or browser settings at any time. Disabling push notifications does not cancel your subscription or your account.

## [5\. Subscription Plans and Billing](#subscription)

Be Prepared offers a Free plan and three paid plans: BeAware, BeReady, and Combo (BeAware + BeReady), each billed monthly or yearly. Current prices are listed on our Pricing page and shown again at checkout before you pay. Subscriptions auto-renew unless canceled. Refunds are governed by Section 6, apply only to annual subscriptions, and are limited to one per user, ever, within 7 days of the first paid annual charge. Monthly subscriptions are not refundable. When you cancel, you keep access until the end of your billing period.

### 5.1 Subscription Plans

Be Prepared offers the following plans. Current monthly and yearly prices for each paid plan are listed at [bepreparedsolutions.co/pricing](https://staging.bepreparedsolutions.co/pricing) and are shown at checkout before you pay. Price changes are handled as described in Section 5.3.

-   **Free:** no charge — Browse the site, purchase pre-made preparedness kits, book BeAdvised consulting sessions, and maintain a basic profile.
-   **BeAware:** BeAware suite for 1 monitored address: real-time emergency alerts, utility outage monitoring, and the 10-year baseline location report.
-   **BeReady:** BeReady suite: personalized AI-generated preparedness plans, full learning library access, and plan sharing with up to 5 family members.
-   **Combo (BeAware + BeReady):** Everything in BeAware and BeReady, expanded to 3 monitored addresses.

Features, limitations, and pricing for each plan are subject to change. We will notify you of any changes that affect your subscription.

### 5.2 Billing and Payment

When you subscribe to a paid plan (BeAware, BeReady, or Combo), you authorize us to charge your payment method on file for the subscription fee. Payments are processed securely by Stripe, our third-party payment processor.

**Payment Methods:** We accept major credit cards and debit cards. You agree to provide current, complete, and accurate payment information. You must promptly update your payment information if it changes or expires.

### 5.3 Automatic Renewal

**Your subscription will automatically renew at the end of each billing period**(monthly or annually, depending on your plan) unless you cancel before the renewal date.

You will be charged the then-current subscription fee for your plan. We will notify you in advance of any price changes. By continuing your subscription after a price increase, you agree to pay the new price.

### 5.4 Cancellation Policy

You may cancel your subscription at any time from your account settings (Profile, then Subscription) or by contacting us at support \[at\] bepreparedsolutions.co.

**When you cancel:**

-   Your subscription will not renew at the end of the current billing period
-   **You will retain access to paid features until the end of your current billing period**
-   After the billing period ends, your account will be downgraded to the Free plan
-   No prorated refunds are issued for partial billing periods. The one-time refund described in Section 6 applies only to annual subscriptions, within 7 days of the first paid annual charge ever made on your account. Monthly subscriptions are not refundable. Canceling a monthly subscription stops the next renewal, but no refund is issued for the current period.

### 5.5 Changing Plans

You may change your subscription plan at any time:

-   **Adding features (e.g. BeAware → Combo, BeReady → Combo):** Takes effect immediately. You will be charged a prorated amount for the remainder of your billing period.
-   **Reducing features (e.g. Combo → BeAware or BeReady):** Takes effect at the end of your current billing period. You retain full access to your current plan until then.

### 5.6 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be suspended or downgraded to the Free plan after a grace period. You remain responsible for any outstanding charges.

### 5.7 Free Trial

We may offer a limited-time free trial of the Combo plan (BeAware + BeReady).

-   **No credit card is required**, no payment method is collected, and **you are never charged** for the trial.
-   The trial lasts **three (3) days (72 hours)** from signup and grants full Combo access. Generating plans, reports, or images requires confirming your email address.
-   **One free trial per email address, ever.** The trial is not available to accounts with an active paid subscription or active complimentary access.
-   **No auto-enrollment.** When the trial ends, your account automatically returns to the Free plan. You are not enrolled in, or charged for, any paid subscription; to continue with paid features you must explicitly purchase a plan.
-   **Your data is saved.** Plans, reports, and settings you create during the trial are retained (locked, not deleted) and are restored when you subscribe.
-   The trial sends transactional emails (a welcome message, an ending-soon reminder, and an at-expiry notice).

## [6\. Refund Policy](#refunds)

Subscription refunds apply only to annual subscriptions and are limited to one per user, ever, within 7 days of the first paid annual charge. Monthly subscriptions are not refundable but can be canceled at any time to stop the next renewal. BeEquipped physical goods are accepted for return within 14 days unopened. Affiliate purchases follow the third-party seller's policy. BeAdvised sessions are non-refundable once booked, but can be rescheduled free up to 24 hours before, and a cancellation within 24 hours becomes a future-booking credit.

### 6.1 Subscription Refunds

⚠️ Important Refund Terms

**Refunds are available only on annual subscriptions, and you are entitled to one (1) refund of annual subscription fees, ever.** You may request a full refund within **7 days of your first paid annual subscription charge** to your account (regardless of which annual subscription product you purchased: BeAware Annual, BeReady Annual, or Combo Annual) through your account billing page or by emailing the address in Section 18. **Monthly subscriptions are not refundable**; if you wish to discontinue a monthly subscription, you may cancel at any time and your subscription will not renew at the end of the current billing period. Once a refund has been issued to your account, all future subscription charges (including renewals, upgrades, downgrades, plan changes, switches between monthly and annual, and re-subscriptions after cancellation) are **non-refundable**, regardless of how recently they were charged. Refunds are processed within 10 business days to the original payment method. We reserve the right to deny refund requests that we believe are fraudulent or abusive.

### 6.2 BeEquipped Physical Goods

BeEquipped operates under two distinct fulfillment models. The BeEquipped user interface identifies which model applies to a given product or kit **before checkout**, and your refund and return rights depend on which model handled your purchase.

#### 6.2.1 Amazon Cart Hand-Off (current default for most products and kits)

For products and kits marked as fulfilled through Amazon (or another third-party retailer), the BeEquipped flow does not sell goods to you. Instead, when you confirm a kit, we generate a list of recommended items and hand you off to the retailer’s shopping cart with those items pre-populated.

-   **Be Prepared, Inc. is not the seller, merchant of record, importer, or distributor of those products.** The retailer (e.g., Amazon.com, Inc. or its sellers) is.
-   Once you leave Be Prepared for the retailer’s cart, you transact directly with the retailer under the retailer’s terms, pricing, taxes, and shipping policies. **We do not see, control, or retain your purchase information, payment instrument, shipping address, or order status.**
-   **Returns, refunds, exchanges, warranty claims, shipping disputes, product-safety issues, and recalls are handled exclusively by the retailer and the underlying seller.**Be Prepared, Inc. cannot accept returns, issue refunds, or mediate disputes for these purchases.
-   Pre-populated cart contents are suggestions only. You are responsible for reviewing items, quantities, variants, prices, and seller identity before completing checkout with the retailer. Items may go out of stock, change price, or be substituted by the retailer between our recommendation and your checkout.
-   Affiliate-program disclosures and our independence-of-recommendations commitment in Section 10 apply to Amazon-fulfilled BeEquipped kits.
-   The product-recommendation, warranty, and assumption-of-risk disclaimers in Sections 7.4, 7.11, 7.12, and 7.15 apply with full force to Amazon-fulfilled purchases.

#### 6.2.2 Direct Sale by Be Prepared, Inc. (when offered)

For products and kits that the BeEquipped interface explicitly identifies as **"Sold by Be Prepared"** at checkout, Be Prepared, Inc. is the merchant of record. The following terms apply only to these direct sales:

-   Goods are accepted for return within 14 days of delivery, provided items are unused, in original packaging, and in resaleable condition
-   Perishables, opened consumables, expired-once-opened items, and personalized items are non-returnable
-   Return shipping is the customer's responsibility unless the item arrived damaged, defective, or materially different from its description
-   Refunds for accepted returns are issued to the original payment method within 10 business days of receipt and inspection
-   Title and risk of loss pass to you on delivery to the carrier shown on the shipping confirmation
-   We disclaim implied warranties to the maximum extent permitted by law; manufacturer warranties (if any) pass through to you as the original purchaser

#### 6.2.3 Identifying Which Model Applies

The BeEquipped checkout flow identifies the fulfillment model and the seller of record for each item. If you are unsure which model applies to a purchase you have already made, contact us at the address in Section 18 and we will confirm. We may change which products are sold directly versus handed off to a retailer at any time without notice; the fulfillment model identified on the BeEquipped interface at the time of your checkout governs that transaction.

### 6.3 Other Affiliate Purchases

Products purchased through affiliate links elsewhere on the Service that are not part of the BeEquipped flow (for example, links inside articles or AI-generated plans pointing to Amazon or other third-party retailers) are likewise sold by the third-party retailer. Be Prepared, Inc. is not the seller and cannot accept returns or issue refunds for those purchases; they are subject to the retailer’s policies.

### 6.4 BeAdvised Sessions

**Rescheduling.** You may reschedule a BeAdvised session at no charge up to 24 hours before its scheduled start time, subject to a reasonable limit on the number of reschedules per booking.

**Cancellations within 24 hours.** BeAdvised sessions are non-refundable once booked. If you cancel within 24 hours of the start time, your payment is converted into a credit toward a future BeAdvised booking. Credits expire 12 months after they are issued and may be applied to a session of equal or greater value. Not attending a session you did not cancel forfeits the payment.

**Sessions we cancel.** If we cancel a session, we will reschedule it, refund your payment, or issue a future-booking credit. Card refunds are returned to your original payment method and typically post within 5 to 10 business days.

**Promotions.** A discount or promotional code applied to a session that is later canceled is not separately restored.

### 6.5 Chargebacks

Disputing a charge with your card issuer without first contacting us may result in account suspension while the dispute is investigated. We encourage you to email us first so we can resolve refund questions directly.

**The information, plans, recommendations, and advice provided by Be Prepared are generated by artificial intelligence and are for informational and educational purposes only.**This content does not constitute:

-   Professional emergency management advice
-   Disaster preparedness consulting services
-   Expert guidance from certified emergency professionals
-   Medical, legal, or financial advice
-   Official government emergency instructions
-   Recommendations from licensed professionals in any field
-   Substitute for professional consultation or expert assessment

You should not rely solely on AI-generated content for life-safety decisions.

### 7.3 Not a Substitute for Professional Services

**Be Prepared is not a substitute for professional emergency management services, government emergency preparedness programs, or expert consultation.** Always follow official guidance from:

-   **FEMA (Federal Emergency Management Agency)** and local emergency management agencies
-   **National Weather Service** for weather-related emergencies
-   **Local law enforcement and first responders** for immediate threats

-   Utility outage data accuracy depends on individual utility company reporting
-   FEMA IPAWS alerts are passed through as received from the federal government
-   Historical and geospatial data may contain errors, gaps, or outdated information
-   Geographic coverage varies and is not guaranteed for all areas

### 7.6 Service Availability During Disasters

Like all internet-based services, Be Prepared depends on internet connectivity and infrastructure availability, which may be disrupted during natural disasters and emergencies. The Service may be unavailable due to:

-   Connectivity outages affecting your internet service provider or backbone providers
-   Infrastructure disruption to our hosting providers and data centers
-   Database system failures or overload
-   Upstream data source failures (utility outage feeds, FEMA IPAWS)
-   Power outages affecting servers
-   Security incidents

**Users should maintain offline copies of critical preparedness information.** We provide PDF download capabilities for this purpose. The absence of an alert from BeAware does not indicate the absence of an emergency in your area.

### 7.7 Assumption of Risk

**YOU ACKNOWLEDGE AND AGREE THAT YOU USE BE PREPARED AND FOLLOW ANY RECOMMENDATIONS AT YOUR OWN RISK.** Emergency preparedness, disaster response, and survival situations involve inherent and significant risks, including but not limited to:

### 8.1 BeReady Click-Through Acknowledgement

The first time you generate a BeReady plan (and again whenever the safety notice version is updated), the Service will present an on-screen acknowledgement summarizing that BeReady output is AI-generated, may contain errors, is not professional advice, and is not a substitute for 911 or official emergency instructions. **You must accept this acknowledgement before the plan is generated.** We record the version, time, and IP address of your acceptance.

### 8.2 Persistent Plan and Route Disclaimers

Generated BeReady plans, evacuation routes, and other AI-derived content carry a non-dismissable safety footer reminding you that the content is AI-generated, that routes have not been verified against current road conditions, and that official emergency instructions take precedence. Sharing, downloading, or printing a plan does not remove this footer; you agree not to alter or strip it when sharing the content with others.

### 8.3 BeAware Alert Disclaimers

BeAware alert cards, alert emails, and (where offered) push or SMS notifications include a short disclaimer that the alert is informational, may be delayed, and does not replace 911 or official sources. As described in Section 4.4, delivery is not guaranteed.

### 8.4 BeAdvised Credential Disclosure

The BeAdvised booking flow displays a credential disclosure stating that advisors are not licensed emergency management, medical, legal, structural, or financial professionals, and that sessions are educational only. Booking a session confirms you have read and accepted this disclosure.
